This terms of use document shall govern the access to and use of Apirho Site and use of the products and services available and accessible on the Apirho Site. The use of this Apirho Site by any person, individual or artificial legal entity (“User” or “you”), who access the Apirho Site or who is/are registered at the Site for various services provided by it, constitutes an agreement to abide by the terms of use below and privacy policy or any subsequently revised or updated terms of use or privacy policy (hereinafter referred to as “Agreement”), just as if you had signed this Agreement.

INTRODUCTION

Apirho is an online information service provider, engaged in rendering information with respectto career and industry awareness, especially in engineering field through its various products andservices available on Apirho Site (hereinafter collectively referred to as “Service”). Before using Apirho Site and Services therein, you should go through the Agreement and agree to same.

Apirho may revise this Agreement from time to time by updating and uploading the same on the Apirho Site and you agree to abide and bound by such Agreement. Your continued use of Apirho Site affirms your consent to accept any new or revised terms of Agreement. These terms will always be available for Users to read on this page.

ELIGIBILITY

By using Apirho Site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms of an Agreement.

Individuals under the age of eighteen (18) years of age (hereinafter referred to as “Minors”) are not permitted to use the Apirho Site without the supervision of a parent or legal guardian. Furthermore, we do not knowingly collect or solicit personal information from Minors or knowingly allow such Minors to register for an online account or to post personal information on Apirho Site.

REGISTRATION

By registering and creating an online account on Apirho Site, You accept and agree to be bound by and comply with the Agreement. If you are acting on behalf of a company or any other artificial legal entity, such company or artificial legal entity is also bound by the Agreement.

After registration and creation of an online account on the Apirho Site, You shall be responsible for any and all activities under your user id. You shall ensure and it shall be your duty to ensure that You provide true, accurate, current and complete information about yourself and/or of any Minor for whom the online account is created. You shall promptly update on Apirho Site or notify us, any subsequent change or modification in the information provided about yourself and/ or of any Minor. You hereby undertake to not to disclose your credentials of online account with Apirho to any person and/or to notify immediately any unauthorised use of your online account with Apirho Site.

SERVICES

Apirho will render its Services to its Users on a non-exclusive basis. You hereby undertake to use the Service of Apirho for your personal and non-commercial use. You undertake to use the Services in compliance to the Agreement. Access to the Services on trial basis or free of cost should not be considered by you as your right to access and use the same. Apirho reserves its right to terminate or withdraw any access to the Services on trial basis or free of cost at any point of time.

The Services rendered on the Site are for information and awareness purposes only and should not be construed as career counselling or guidance. Apirho is not responsible for any decision taken pursuant to the information provided on the Site.

PAYMENT

Services rendered by Apirho, through Apirho Site to you shall be subject to the payment of fees.You shall be allowed access to these Services only after making payment of prescribed fees to Apirho. You are responsible for paying all fees and applicable taxes in a timely manner with a payment mechanism associated with the applicable paid Services. Fees may vary based on your location and other factors, and Apirho reserves the right to change any fees at any time at its sole discretion. Any change, update, or modification will be effective immediately upon posting through the relevant Services. The determination of the fee shall be the sole discretion of Apirho.

Apirho uses third party payment gateways to receive payments from user. Apirho is not responsible for delays or erroneous transaction execution or cancellation of orders due to payment issues. Apirho takes utmost care to work with third party payment gateway providers, but does not control their systems, processes, technology and work flows, hence cannot be held responsible for any fault at the end of payment gateway providers.

LICENSES AND RESTRICTIONS

Subject to the acceptance of these terms or the Agreement, Apirho grants User a limited, non-exclusive, non-assignable, revocable license to access and make personal, but non-commercial use of the contents of the Apirho Site (“Content”).

The foregoing licenses do not include any rights to:

License, sub license, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to any third party the Services or Apirho Site in any way;
modify, download (other than page caching), reproduce, copy, or resell the Apirho Site, the Content or any portion or derivative thereof;
commercially use the Apirho Site, the Content or any portion derivative thereof;
create any links to the Services or Apirho Site;
copy or download Services, Content and/or any User’s account or profile information for the benefit of any third party;
enable high volume, automated, electronic processes that apply to the Apirho Site or its systems, the Content or any portion or derivative thereof;
use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access,acquire, copy or monitor any portion of the Apirho Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Apirho Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Apirho Site. We reserve the right to bar any such activity.
Use infringing, obscene, threatening, libelous, or otherwise unlawful or tortuous material on the Apirho Site, including material harmful to other Users or violative of any applicable laws and/or third party privacy rights;
interfere or attempt to interfere with the proper working of the Apirho Site;
bypass any Apirho measures used to prevent or restrict access to any portion of the Apirho Site, the Content or any portion or derivative thereof;
frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Apirho;
Reverse engineer the Apirho Site or its Content;
use Apirho name, trademarks, services marks or logos or any other “hidden text”; or
compile, repackage, disseminate or otherwise use data extracted from the Apirho Site.

The foregoing is expressly prohibited; the right to do any of the foregoing shall require Apirho’s express written consent (which may include a written agreement signed by an authorized representative of Apirho). Any unauthorized use of the Apirho Site, the Content or any portion or derivative thereof shall terminate any license or permission granted by Apirho.

You hereby agree and undertake that You shall restrict yourself from hosting, displaying, uploading, modifying, publishing, transmitting, updating or sharing any information or share /list (s) any information or item that:

Belongs to another person and to which You do not have any right ;
Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic,paedophilic, libelous, invasive of anothers privacy, hateful or racially, ethically,objectionable, disparaging, relating or encouraging money laundering or gambling or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to “indecent representation of women” within the meaning of the Indecent Representation of Women ( Prohibition) Act,1986;
Harm Minors in any way;
Infringes any patent, trademark, copyright or other proprietary rights or third party’s trade secrets or right of publicity or privacy or shall not be fraudulent or involved the sale of counterfeit or stolen items;
Involves the transmissions of “junk mails”, “chain letters”, or unsolicited mask mailing or “spamming”;
Violates any law for the time being in force;
Deceives or misleads addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
Impersonate another person;
Contains software viruses or any other computer code, file or programs designed to interrupt, destroy or limit the functionality of any computer resources;
Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the communication of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

TAXES

You agree to bear all applicable taxes, charges cess etc. levied on the Services being rendered to you as notified by the Central/State Government from time to time, unless already included in the fee.

MEANS OF COMMUNICATION; YOUR INFORMATION AND PASSWORD

Every User that has an account on the Apirho Site is responsible for (i) keeping his or her account password confidential and secured, (ii) avoiding unauthorized access to such User’s computer; and (iii) keeping the e-mail address associated with that account current. In no event will Apirho be liable for the unauthorized use or misuse of your password.

By registering on the Apirho Site, you certify that all information you provide, now or in the future, is accurate. You also accept that we may contact you by SMS or email or any other means for verification and communication purposes.

DEFICIENCY IN SERVICES

Neither Apirho (including it and its’ directors, employees, affiliates, agents, representatives or subcontractors) shall be liable for any loss or liability resulting, directly or indirectly, from any deficiencies, delays or interruptions due to electronic or mechanical equipment failures, updates, repairs, telephone interconnect problems, defects, weather, strikes, walkouts, fire, acts of God, riots, armed conflicts, acts of war, or other like causes.

CANCELLATION AND REFUND POLICY

Apirho offers only online Services. Once the customer has paid the license fee for these, the license is granted and Services are rendered immediately, therefore there is no provision for refund of fee paid by the User/s.

Cancellation requests of Services once licensed and made available are not accepted. Hence, no requests for refunds will be entertained.

LIABILITY DISCLAIMER

YOU EXPRESSLY ACKNOWLEDGE AND CONFIRM THAT USE OF THE Apirho Site IS AT YOUR SOLE RISK.

Apirho does not guarantee that files available for downloading through the Service will be free of contaminating or damaging code such as viruses, trap doors and the like. Apirho does not endorse content, nor warrant the accuracy, completeness, correctness, timeliness or usefulness of any opinions, advice, content, services provided through the Service.

THE Apirho Site AND SERVICES PROVIDED THROUGH OR IN CONNECTION WITH IT, ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. Apirho EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR CONTENT OF INFORMATION OR SERVICES. Apirho MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES Apirho MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE. YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA. Apirho MAKES NO WARRANTY REGARDING ANY SERVICES LICENSED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM Apirho OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

NEITHER Apirho NOR ANY OF ITS PARTNERS, AGENTS, AFFILIATES OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO GAIN ACCESS TO OR USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY.

Furthermore, the Content is not intended to be a substitute for professional and/or psychological advice or counselling. Reliance on any information appearing on the Apirho Site is strictly at your own risk.

THE CONTENT OF THE APIRHO SITE IS INTENDED FOR INFORMATION PURPOSES ONLY. SUCH CONTENT IS NOT INTENDED TO, AND DOES NOT, CONSTITUTE LEGAL, PROFESSIONAL, PSYCHOLOGICAL, ADVICE OR COUNSELING, AND MAY NOT BE USED FOR SUCH PURPOSES.

CONSEQUENCES OF BREACH

Apirho reserves a right to suspend or terminate your account with Apirho and restrict your access to the Apirho Site in the following events:

If you commit breach of any of the terms or provisions of the Agreement, privacy policy;
If the information provided by you at the time of registration is not true, correct and cannot be authenticated;
If Apirho believes that your registration on Apirho Site, access to the Apirho Site and use of Apirho Site will cause an liability for other users or Apirho;
If Apirho believes that your registration with Apirho Site may cause reputational risk to Apirho.

You hereby acknowledge that once your account with Apirho Site is suspended or terminated, you shall not be allowed to access or use the Apirho Site or register again and create a new account with Apirho Site.

Notwithstanding the forgoing, in the event your account is suspended or terminated due to breach of any of the terms or provisions of the Agreement, Apirho reserves right to forfeit the fees paid by you and to take appropriate strict legal action against you.

INDEMNIFICATION

You agree to indemnify and hold Apirho, its parents, subsidiaries, affiliates, officers, agents, employees, partners, licensors and content partners harmless from any dispute which may arise from a breach of terms of this Agreement. You agree to hold Apirho harmless from any claims and expenses, including reasonable legal fees and court costs, related to your violation of this Agreement.

User agrees to indemnify and hold Apirho, its parents, subsidiaries, affiliates, officers, agents, employees, partners, licensors, agents, affiliates and content partners harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of such User’s use, or submission, as applicable, to the Apirho Site, submitted by User, breach of the Terms of Use or User’s violation of any law or the rights of a third party.

INTELLECTUAL PROPERTY RIGHTS

The materials provided on the Apirho Site for Service are for personal use only. You acknowledge that the Service contains information, software, photos, videos, graphics, designs, music, sounds or other material (collectively, “Content”) that are protected by copyrights, trademarks, trade secrets or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereafter developed. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the Content, in whole or in part. You may not upload, post, reproduce or distribute Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other proprietary right. Apirho or its affiliates, or third parties from whom Apirho has permission, own the trademarks or service marks that are used on the Apirho Site. All rights are reserved. These and other graphics, logos, service marks, trademarks and trade dress of Apirho and its licensors may not be used without prior written consent of Apirho or its licensor, as the case may be. Without limiting the foregoing, no Apirho trademark or trade dress may be used in connection with any product or service that is not Apirho’s, in any manner that is likely to cause confusion among Users, or in any manner that disparages or discredits Apirho.

USER CONTENT

The Services enable you to share your content, such as answers to assignments you submit, posts you make in the forums, and the like (“User Content”), with Apirho and/or other Users. You are responsible for the User Content you share.

How Apirho may use User Content

To the extent that you provide User Content, you grant Apirho a fully-transferable, royalty-free, perpetual, sub-licensable, non-exclusive, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, and otherwise use the User Content. Nothing in these Terms shall restrict other legal rights Apirho may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms.

BAR ON COPYING OR DISTRIBUTION

You may not reproduce, copy or redistribute the design or layout of Apirho Site, individual elements of the Site design, Apirho logos or other logos appearing on the Site, without the express written permission of Apirho. Reproduction, copying or redistribution for commercial purposes of any materials or design elements on the Apirho Site is strictly prohibited without the express written permission of Apirho, Images and descriptions of products may be supplied to us by third parties, who reserve all rights in those materials.

USE OF COMMUNICATION FORUMS

The Apirho Site may offer opportunities for interactive activities, which enable Users to post information and other material that will be visible to other Users of those services. These services may be used only for lawful purposes in accordance with these Terms of Use. If you post, publish or communicate any information, data, software, photographs, graphs, videos, typefaces, graphics, music, sounds, and other material on or through Apirho site, please choose carefully the information that you post and/or provide to other Users.

User is prohibited from posting on or transmitting through Apirho Site any unlawful, libelous, tortious, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, is injurious to the health of any User or otherwise violates any applicable law. Apirho reserves the right, in its sole discretion, to reject, refuse to post or remove any posting or other content (including private messages) by you, or to deny, restrict, suspend, or terminate access to all or any part of the Services at any time, for any or no reason, with or without prior notice or explanation, and without liability.

Notwithstanding the foregoing, Apirho assumes no responsibility for ongoing monitoring of the Apirho Site or for removal or editing of any content contributed by User, even after receiving notice. Apirho assumes no liability for any action or inaction with respect to Use of Communication forums provided by the Site.

The Apirho online interactive community is not designed for use by Minors (as defined in the Eligibility Section above). individuals under the age of 18 must participate in the community only under the supervision of a parent or legal guardian.

You may not post content that: involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming,” “phishing” or “spamming”; contains restricted or password only access pages or hidden page or images (those not linked to or from another accessible page); solicits passwords or personal identifying information for commercial or unlawful purposes from other Users; involves commercial activities and/or sales such as contests, sweepstakes, barter, advertising, or pyramid schemes; includes a photograph or video of another person that you have posted without that person’s consent; circumvents or modifies, or attempts to circumvent or modify, or encourages or assists any other person in circumventing or modifying any security technology or software that is part of the Apirho Site; involves the use of viruses, bots, worms, or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of or access to a computer or a computer network; covers or obscures the banner advertisements on your personal profile page; involves any automated use of the Apirho Site, such as, but not limited to, using scripts to add friends or send comments or messages; interferes with, disrupts, or creates an undue burden on the Apirho Site or the networks; impersonates or attempts to impersonate another User, person or entity; uses the account, username, or password of another User at any time or discloses your password to any third party or permits any third party to access your account; sells or otherwise transfers your profile; uses any information obtained from the Apirho Site in order to harass, abuse, or harm another person or entity, or attempting to do the same.

MOBILE APPLICATIONS AND USE

If Apirho offers products and services through applications available on your wireless or other mobile device (such as a mobile phone) (the “Mobile Application Services”), these Mobile Application Services are governed by the additional terms and conditions governing the
applicable Mobile Application Service.

Not all Apriho services are available on mobiles. Some of our services can be viewed well only on laptops/desktops and not on mobile phones. Apirho is not responsible if the User cannot access these on mobiles. Apirho does not guarantee optimal use of the site on mobiles. The site is meant for use on laptops/desktops. You are responsible for providing, at your own expense, all equipment necessary to use the services, including a computer, modem, and Internet access (including payment of all fees associated with such access).

We do not charge for these Mobile Application Services unless otherwise provided in the applicable Additional Terms. However, your wireless carrier’s standard messaging rates and other messaging, data and other rates and charges will apply to certain Mobile Application Services. You should check with your carrier to find out what plans your carrier offers and how much the plans cost. In addition, the use or availability of certain Mobile Application Services may be prohibited or restricted by your wireless carrier, and not all Mobile Application Services may work with all wireless carriers or devices. Therefore, you should check with your wireless carrier to find out if the Mobile Application Services are available for your wireless device, and what restrictions, if any, may be applicable to your use of such Mobile Application Services. If you change or deactivate your wireless telephone number, you agree to promptly update your Mobile Application Services account information to ensure that your messages are not sent to the person that subsequently acquires your old number.

Under no circumstances will Apirho be responsible for any wireless email, text messaging or other charges incurred by a User (or any person that has access to a User’s wireless device, telephone number, or email address) using any Mobile Application Services.

The Apirho Site may contain hyperlinks to other web sites (“Other Sites”). If you use the hyperlinks to access these Other Sites, you will leave the Apirho Site and will be re-directed to the Other Sites. The Other Sites may have their own terms of service and privacy policy and those Other Sites may have different practices and requirements than the Apirho Site. TERMINATION

I. By Apirho

Your use of the Service and/or Content and/or Apirho Site is subject to all applicable local, state, national and international laws and regulations in existence in the state and country from where you are accessing the Apirho Site. Apirho retains the right, at Apirho’s sole discretion, to determine whether or not your conduct is consistent with this Agreement and Apirho’s operating rules or policies and may terminate your access to and use of the Service if your conduct is found to be inconsistent with this Agreement, such rules or policies.

II. By user

If you are registered to use the Apirho Site, you may deactivate your account on the Apirho Site, at any time and for any reason, although we will be sorry to see you leave.

We may terminate your use of and registration on the Apirho Site, at any time and for any reason, with or without cause, without prior notice to you and without any liability or further obligation of any kind whatsoever to you or any other party.

We are constantly changing and improving our Services. We may add or remove functions, features, or requirements, and we may suspend or stop a Service altogether. Accordingly, Apirho may terminate your use of any Service for any reason. If your use of a paid Service is terminated, a refund may be available under our Refund Policy. Apirho shall not have any liability to you for any such action.

INTERNATIONAL USE

Although this Site may be accessible worldwide, we make no representation that materials on this Site are appropriate or available for use in locations outside India, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with local laws. Apirho may give notice by means of a general notice on the Site, or by electronic mail to your e- mail address on record in Apirho’s account information, or by written communication sent by regular mail to your address on record in Apirho’s account information.

You agree that all the agreements, notices, disclosures and other communications that we provide to you electronically shall be deemed adequate service of notice/ electronic record.

FEEDBACK

Apirho is always open to the suggestions of the User/s and shall endeavour to implement all such suggestions that may enhance the utility to the User/s for the benefit of User/s as well as Apirho.

By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you. By accepting your Feedback, Apirho does not waive any rights to use similar or related Feedback previously known to Apirho, developed by its employees or contractors, or obtained from other sources. Apirho is not bound by suggestions/Feedback in any manner whatsoever.

PARTICIPATION IN PROMOTIONS

From time to time, this site the Site may include advertisements offered by third parties. You may enter into correspondence with or participate in promotions of the advertisers showing their products on this site the Site. Any such correspondence or promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such correspondence or promotions, are solely between you and the advertiser. DISPUTE RESOLUTION AND GOVERNING LAW

The terms of this agreement are exclusively based on and subject to Indian law.
